TERMS & CONDITIONS – Antefact

These Terms & Conditions (“Terms”) govern access to and use of the Antefact website and all purchases made through it. By placing an order, you agree to these Terms.

“Antefact”, “we”, “us” or “our” refers to the seller identified above.
2. Scope & Consumer Status
These Terms apply primarily to consumer sales (B2C).
By placing an order, you confirm that you are acting as a private consumer. If a sale is concluded with a professional buyer, consumer protection rules may not apply and Belgian civil law governing professional sales shall prevail.
3. Products – Antiques, Vintage Objects & Works of Art
Antefact sells:
- Antiques and vintage objects
- Decorative arts and collectibles
- Works of art, including paintings, drawings, prints, etchings, sculptures, and mixed-media works
3.1 Unique & One-Off Items
In general, items offered for sale are unique, one-of-a-kind pieces. Once sold, an item cannot be replaced or exchanged.
3.2 Condition & Age
Most items are previously owned and may show signs of age, wear, patina, craquelure, foxing, discoloration, restorations, or prior conservation. These characteristics are normal and inherent to antiques, vintage objects, and artworks and do not constitute defects.
3.3 Descriptions, Attribution & Authenticity
Descriptions, titles, artist attributions, periods, dates, origins, materials, dimensions, and condition reports are provided in good faith, based on expertise, stylistic analysis, available documentation, and prevailing market standards.
Unless expressly stated otherwise:
- Attributions, dates, schools, or origins constitute professional opinions, not absolute guarantees
- Artistic quality, market value, and scholarly interpretation are subjective and may evolve over time
Buyers are encouraged to request additional information or images before purchase.
4. Order Process & Contract Formation
Placing items in the shopping cart does not constitute a binding contract.
A legally binding contract is formed only when:
- We confirm acceptance of your order by email, or
- The item is dispatched to you
Antefact reserves the right to refuse or cancel orders in case of error, unavailability, incorrect pricing, or suspected fraud.
5. Prices & Payment
- All prices are in EUR (€) and include Belgian VAT where applicable
- Shipping costs are displayed at checkout or quoted separately
- Payment must be completed in full before dispatch
Antefact reserves the right to correct obvious pricing or typographical errors.
6. Delivery, Shipping, Pickup & Personal Delivery
6.1 Delivery Areas
We ship within Europe and internationally, depending on the nature, size, and fragility of the item.
6.2 Delivery Times
Delivery times are indicative only and not binding. Delays caused by carriers, customs, or force majeure cannot give rise to compensation.
6.3 Risk Transfer
Risk passes to the customer upon physical delivery of the item.
6.4 Inspection on Receipt
The customer must inspect the delivery immediately.
Any visible damage must be reported to the carrier and to Antefact within 48 hours.
6.5 Pickup & Personal Delivery
In certain cases, an item may be collected in person by the customer or delivered by Antefact or a third party designated by Antefact, depending on the nature, size, or fragility of the object.
Pickup or personal delivery is only possible after prior contact and written confirmation by Antefact.
The customer must contact Antefact by email in advance to discuss feasibility, conditions, timing, and any applicable costs.
Until written confirmation is provided, standard shipping terms apply.
7. Right of Withdrawal (Cooling-Off Period)
Consumers have the right to withdraw from the purchase within 14 calendar days from the day after receipt of the item, without giving a reason.
7.1 Exercise of the Right
Withdrawal must be notified to Antefact in writing (email is sufficient) before the withdrawal period expires.
7.2 Return Conditions
Returned items must:
- Be in the same condition as delivered
- Not be altered, restored, cleaned, framed, or damaged
- Be carefully repackaged
Due to the nature of antiques and artworks, handling beyond normal inspection may affect eligibility for return.
7.3 Costs & Refunds
- Return shipping and insurance costs are borne by the customer
- Original shipping costs are non-refundable
- Refunds are issued within 14 days after receipt and inspection of the returned item
7.4 Exclusions
The right of withdrawal may be excluded for:
- Items explicitly marked as non-returnable
- Custom framing, special orders, or reserved items
8. Legal Warranty, Conformity & Hidden Defects
Belgian consumer law applies.
Consumers benefit from statutory remedies in case of:
- Lack of conformity existing at the time of delivery
- Hidden defects as defined by Articles 1641–1649 of the Belgian Civil Code
Given the nature of antiques and artworks:
- Age-related wear, artistic techniques, and material aging are not defects
- Subjective elements such as taste, artistic quality, or market value are excluded
- Claims must be reported within two (2) months of discovery
9. Authenticity, Attribution & Period – Legal Notice
Antefact describes and presents all antiques, vintage objects, and works of art in good faith, based on current knowledge, expertise, stylistic analysis, available documentation, and prevailing market standards.
Any reference to an artist, maker, period, date, origin, school, material, or technique reflects a professional opinion and does not constitute an absolute or perpetual guarantee, unless expressly stated otherwise.
Antefact remains liable for any lack of conformity existing at the time of delivery within the applicable legal warranty period, and for remedies provided by the Belgian Civil Code in the event of hidden defects or proven misrepresentation.
Given the nature of antiques and artworks, differences of scholarly or expert opinion regarding attribution, age, or origin do not automatically constitute a lack of conformity or defect.
No extended or commercial guarantee of authenticity, attribution, or period is granted beyond statutory legal guarantees, unless expressly stated in writing for a specific item.
10. Retention of Title
Ownership of the item remains with Antefact until full payment has been received.
11. Intellectual Property
All website content (texts, images, logos, layout) is protected by intellectual property law and remains the exclusive property of Antefact or its licensors.
Reproduction or commercial use without prior written permission is prohibited.
12. Liability
Antefact shall not be liable for:
- Indirect or consequential damages
- Changes in market value of antiques or artworks
- Improper handling, storage, framing, conservation, or restoration by the buyer
Total liability is limited to the purchase price of the item concerned, except where mandatory law provides otherwise.
13. Force Majeure
Antefact shall not be liable for delays or failure due to force majeure, including transport disruption, strikes, customs delays, or technical failures.
14. Governing Law & Dispute Resolution
Belgian law applies.

15. Privacy Policy (GDPR)
Antefact processes personal data in accordance with GDPR and Belgian data-protection law.

Retention
- Accounting data: 7 years

You have the right to access, correct, delete, restrict, object to processing, and data portability.
Complaints may be lodged with the Belgian Data Protection Authority.

No marketing or advertising cookies are placed without explicit consent.
17. Language and Translations
The original and legally binding version of these Terms & Conditions is the English version. Product descriptions, condition reports, dimensions, and other information may be translated automatically, using AI-assisted translation tools. In case of doubt, the English version shall prevail.
While reasonable efforts are made to ensure the accuracy of such translations, Antefact does not guarantee that translated versions are free from errors, omissions, or inaccuracies.
In the event of any discrepancy, inconsistency, ambiguity, or conflict between the English version and any translated version, the English version shall prevail and be legally binding.
Customers who have any doubt regarding the meaning or interpretation of a translated text are encouraged to contact Antefact before placing an order.
